1. Acceptance of Terms
By using Animate-Image.com, you agree to these Terms, as well as any future modifications or amendments we may make. Continued use of the Service signifies your acceptance of any changes. These Terms apply to all visitors, users, and others who access or use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind the organization to these Terms.
2. Eligibility
The Service is only available to individuals who are at least 18 years old or the age of legal majority in their jurisdiction of residence. If you are under 18, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet the eligibility requirements.
3. Account Registration
To access the features of the Service, you must create an account. You agree to provide accurate, complete, and up-to-date information during the registration process and to update such information as necessary to keep it accurate and complete. You are responsible for safeguarding your password and for all activities or actions that occur under your account. You agree to notify us immediately if you suspect any unauthorized use of your account.
4. Trial, Subscription Plans, and Credits
1. Free Trial: We offer a 7-day free trial to new users. During the free trial period, you will receive 50 credits to explore and use our Service. To activate the free trial, you must provide valid credit card information during registration. If you do not cancel the trial before the end of the 7-day period, the subscription plan you selected at registration (Basic or Premium) will automatically begin, and your credit card will be charged accordingly. You may cancel the free trial at any time before the 7-day period ends by accessing your account settings.
2. Subscription Plans:

Users may subscribe to one of the following plans:

  • Basic Plan: $9.99 per month, includes 1,000 credits per month.
  • Premium Plan: $19.99 per month, includes 2,000 credits per month.

    • Subscription credits are provided at the beginning of each billing cycle and are valid only for that month. Unused credits do not carry over to the next month and expire at the end of each billing cycle.

    3. Purchased Credits

    In addition to subscription credits, users have the option to purchase additional credits in bundles, currently available in increments of 500, 1,000, or 2,000 credits (subject to change).

  • Expiration: Purchased credits do not expire as long as your account remains active.
  • Account Cancellation: If you cancel your subscription, any remaining purchased credits will expire upon the cancellation date, and you will no longer have access to them. Maintaining an active account is required to retain purchased credits.
    • 4. Payment and Billing
  • All subscription fees are billed on a recurring monthly basis and are non-refundable, except as provided in our Refund Policy.
  • You must provide a valid credit card or payment method to maintain an active subscription. If your payment fails for any reason (e.g., insufficient funds, expired card), we may suspend or terminate your access to the Service until the issue is resolved.
  • Prices for subscriptions and credits are subject to change with prior notice. You will be notified of any price changes in advance, and your continued use of the Service after the changes go into effect constitutes acceptance of the new prices.
    • 5. Cancellation

    You may cancel your subscription at any time by visiting your account settings. Upon cancellation, your subscription will remain active until the end of the current billing cycle, but any unused subscription credits will expire at the end of that cycle. No prorated refunds will be issued for any remaining portion of the subscription term.

    If you wish to cancel and retain any remaining purchased credits, you must keep your account active.

    5. Payment and Billing

    You agree to provide valid and current payment information at the time of purchase. You authorize us to charge your credit card or other payment method for the recurring subscription fees applicable to the plan you select. If any payment is not successfully processed due to expiration, insufficient funds, or other reasons, we reserve the right to suspend your access to the Service until payment is made.

    Your subscription will automatically renew at the end of each billing cycle unless you cancel it. Subscription fees are subject to change with notice, and you will be given the option to cancel if you do not agree to the new fees.

    6. Use of Third-Party AI Services

    Animate-Image.com integrates third-party AI services to provide image and video generation, upscaling, and editing tools (collectively, "AI Services"). These services may include but are not limited to those provided by Stability.ai, Runway ML, and others.

    By using our platform, you agree to comply with the terms of service and acceptable use policies of these third-party providers. Their terms may impose additional restrictions on your use of the content generated via their services, and it is your responsibility to understand and adhere to their requirements. The providers we work with may change over time, and updates will be reflected in our documentation.

    You must not use any AI Service to generate content that violates the law or is harmful, violent, discriminatory, infringing, or otherwise objectionable. Animate-Image.com reserves the right to remove or block any content that violates these Terms or the policies of our third-party providers.

    7. Prohibited Conduct

    You agree not to misuse the Service or engage in any of the following activities:

  • Creating multiple accounts to abuse the free trial offer or any promotions.
  • Using the Service to create or distribute unlawful, harmful, abusive, threatening, defamatory, or infringing content.
  • Violating any applicable law, regulation, or third-party rights.
  • Impersonating any person or entity or falsely claiming an affiliation with any person or entity.
  • Attempting to gain unauthorized access to any part of the Service, other accounts, or computer systems.
  • Interfering with the proper functioning of the Service, including by introducing malicious code or exploiting the Service for purposes beyond what is allowed.

    • Violation of these rules may result in the immediate suspension or termination of your account, and may also result in legal action.

    8. User Content and Intellectual Property
  • Ownership: You retain all rights to the content you create using the Service ("User Content"). However, by creating, uploading, or sharing content on the platform, you grant Animate-Image.com and its third-party service providers a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, modify, and distribute your content for the purpose of providing and promoting the Service.
  • Responsibility: You are solely responsible for the content you create or upload, and you represent and warrant that you own or have all necessary rights to the content you provide. You must not upload or create any content that violates the intellectual property rights of others, infringes upon their privacy, or breaches any applicable law.
  • Prohibited Content: You must not create or distribute content that is unlawful, defamatory, obscene, or otherwise violates third-party rights, including but not limited to intellectual property rights and privacy rights.
    • 9. Refunds and Cancellations
  • Refunds: Subscription fees are non-refundable. In rare circumstances, we may issue refunds or credits at our discretion, such as in cases of prolonged service outages. Refund requests must be submitted via email or through your account portal, and the decision to issue a refund will be made solely by us.
  • Cancellations: You can cancel your subscription at any time by accessing your account settings. Upon cancellation, your subscription will remain active until the end of the current billing cycle, and no prorated refunds will be issued for any unused portion of the subscription term.
    • 10. Termination or Suspension of Accounts

    We reserve the right to terminate or suspend your account, with or without notice, for any reason including but not limited to:

  • Violating these Terms or any applicable laws.
  • Engaging in prohibited conduct as outlined above.
  • Creating multiple accounts or abusing promotional offers.

    • If your account is suspended or terminated, you may lose access to any content or features available on the Service. Termination or suspension of your account does not release you from any payment obligations accrued prior to such termination.

    11. Indemnification

    You agree to indemnify, defend, and hold harmless Animate-Image.com, SNAPI LLC, its affiliates, officers, employees, and third-party providers from any claims, liabilities, damages, losses, or expenses (including attorney’s fees) arising from:

  • Your use of the Service.
  • Your breach of these Terms.
  • Your violation of any applicable laws or rights of any third parties.
    • 12. Data Privacy and GDPR Compliance

    For users located in the European Union (EU), we comply with the General Data Protection Regulation (GDPR).     13. Service Availability and Modifications

    We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not responsible for any loss or damage you may suffer as a result of any changes to the Service or its availability.

    We may also impose limits on the Service, such as the number of credits or the amount of content you can generate, as part of your subscription plan.

    14. Limitation of Liability

    To the fullest extent permitted by law, Animate-Image.com, SNAPI LLC, and our affiliates, partners, employees, or licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from:

  • Your use of the Service.
  • Any disruption or unavailability of the Service.
  • Content generated or provided through third-party AI services.

    • Our total liability to you for any claim or dispute related to these Terms or the Service shall not exceed the amount you have paid us for the Service in the six (6) months preceding the claim.

    15. Dispute Resolution and Arbitration
    Any disputes arising out of or in connection with these Terms shall be resolved by binding arbitration, conducted in accordance with the rules of the District Court in Miami, Florida, USA. You agree to waive any right to a trial by jury or to participate in any class action. Arbitration will be conducted in English, and judgment upon the arbitration award may be entered in any court of competent jurisdiction.
    16. Governing Law
    These Terms and any disputes arising out of or relating to them are governed by the laws of [Your Jurisdiction], without regard to its conflict of laws provisions. You agree to submit to the exclusive jurisdiction of the courts of Miami, Florida, USA.
